The terms on which JobSite is provided

JobSite is provided by BaldwIndustries Inc. and governed by the law of Ontario. It is pre-release, and no fees are in effect.

Acceptance of these terms

By accessing or using JobSite (“the Service”) you agree to be bound by these terms. If you do not agree to them, do not use the Service. The Service is provided by BaldwIndustries Inc.

What the Service is, and its stage

JobSite is construction-management software for builders and contractors: project records, estimating, permit and inspection tracking, holdback-aware invoicing and client communication.

The Service is pre-release and is not generally available. It is provided “as is”, features may change or be withdrawn, and parts of it depend on providers that are not enabled in every environment. Capabilities that are not available are named on the pages that describe them rather than implied to work.

Accounts

Some features require an account. You are responsible for the confidentiality of your credentials and for activity under your account, and you agree to provide accurate information and keep it current. Access within an organization is scoped by role.

Fees and billing

No fees are in effect and nothing is charged for use of the Service. There is no published price and no paid plan, creating an account does not collect a payment method, and no payment instrument is stored for you.

If paid plans are introduced, the price and the terms that apply to them will be published before they apply to anyone, and continued use after that publication will be the point at which they take effect. Nothing on this site or in the Service should be read as a commitment about what a future price will be, when it will arrive, or what any account will receive.

Acceptable use

You agree not to:

  • use the Service for an unlawful purpose;
  • attempt to gain unauthorized access to any part of the Service or to another organization’s records;
  • interfere with or disrupt the Service or its infrastructure;
  • upload malicious code or content;
  • impersonate a person or an entity;
  • scrape, crawl or spider the Service without written permission;
  • use the Service to send unsolicited commercial messages.

Intellectual property

The content, features and functionality of the Service — text, graphics, marks and software — are owned by BaldwIndustries Inc. or its licensors and are protected by copyright, trade-mark and other laws. You may not reproduce, distribute or create derivative works from them without written permission.

Your content and your data

You retain ownership of the content you submit. You grant BaldwIndustries Inc. a worldwide, non-exclusive, royalty-free licence to use, reproduce and display it only as needed to operate the Service for you. You represent that you have the right to submit it and that it does not infringe a third party's rights.

Retention periods, the export window that applies on deletion, and how to make an access, correction, export or deletion request are set out in the privacy notice, which forms part of these terms.

Limitation of liability

To the fullest extent permitted by law, BaldwIndustries Inc. is not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of the Service. Total liability will not exceed the amount you paid for the Service in the twelve months preceding the claim — which, while no fees are in effect, is nil.

Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. JobSite is software, not legal, accounting or professional advice: statements about Ontario law on this site are general information and outcomes under those rules are never promised.

Termination

Either party may stop. BaldwIndustries Inc. may suspend or terminate an account for conduct that violates these terms or is harmful to other users, to it, or to third parties. On termination your right to use the Service ends; the export window described in the privacy notice applies to your data.

Governing law

These terms are governed by the law of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law principles. Disputes arising from these terms are to be resolved in the courts of Ontario.

Changes to these terms

These terms may be updated. Material changes will be published on this page with a new date and shown as a notice inside the Service. Notification by email is not currently operating and is therefore not relied on. Continued use after a change takes effect constitutes acceptance of it.

There is no address to write to yet

Contact is being provisioned. JobSite is pre-release and does not yet have a monitored public mailbox. Until one is published here, this site cannot accept a message — please do not send project details, credentials or personal information to any address on this page.

This section previously published an address that had no mail record behind it and bounced. On a document that governs a contractual relationship, an unreachable notice address is a defect rather than a formality, so it has been removed rather than replaced with another untested one.

A signed-in organization should raise a question about these terms from inside JobSite. The privacy notice sets out the independent escalation available for privacy matters.
